1. Objective of the advertising policy

The rules governing this policy apply to all advertising activity on the 3warnings website and mobile application that promotes, through its advertisements and subscription channels, the purchase of certain goods or services. Likewise, the content of this document applies to the advertisements issued by 3warnings’ advertising Users that have the purpose of promoting certain behaviors.

2. Basic rules

Apart from the provisions of the Code of Conduct and the specifications stipulated in point 4 of this policy for the services and products that are advertised, Users are obliged to respect and are subject to the following guidelines.

2.1. Good faith

The publicity used in the project may not be contrary to the principles of good faith, that is, there is no awareness on the part of the Users that they are violating the rights of third parties or regulations.

2.2. Legality

Publicity must also be considered legal, in accordance with the values, rights and principles recognised in the supreme rules of each country.

2.3. Violence

Advertising should not incite violence, nor should it propose or imply any kind of advantageous attribute in violent behaviour.

2.4. Discrimination

Advertising displayed may not discriminate against any race, nationality, sex or sexual orientation or religion, or other factors.

2.5. Right to honour

Similarly, respect for the rights to honour, privacy and self-image will be taken into account when presenting advertisements.

2.6. Security

Advertising may also not encourage the practice of dangerous or potentially dangerous behaviour; an exception is made when it is carried out to promote safety in such behaviour.

2.7. Behaviors

In addition to the above, advertising will not instigate illicit, immoral or generally illegal behaviour.

2.8. Environment

Advertising displayed will not instruct in harmful and environmentally damaging behaviour or practices.

2.9. Truthfulness

The advertising that forms part of the project may not be misleading, this being understood as that intended to mislead the person to whom it is addressed, and may significantly distort the economic behaviour of the consumer, who may make a decision based on this advertising that, otherwise, he would not have made. For example, in an enunciative way:

  • The making of a commercial offer of a product and/or service knowing that there will not be sufficient stock, according to the scope of the advertising and the price provided;

  • Advertising which contains an error in the typography of the price, provided that it is attributable to bad faith.

  • Practices that create confusion among users with the risk of associating a product and/or service with another trademark

  • Offering users a product and/or service as free or without charge, on which they must then pay money as a concept of payment for its delivery or collection.

2.10. Defamation

Advertising offered to users should also not disparage or denigrate other similar activities, products, services or businesses.

2.11. Exploitation and/or imitation

Advertising shall not refer explicitly or implicitly to the distinctive signs of another advertiser, except in cases permitted by law. Similarly, there may be no imitations in text, slogan, music, presentation or distinctive signs when any of those elements are protected by industrial and intellectual property rights.

2.12. Health

Likewise, advertising on the platforms will avoid encouraging users to take actions that could be harmful to health.

3. Requirements for the publication of advertisements

3warnings only supports advertisements that meet the specific requirements provided in this policy.

3.1. Text Ads

Text ads, in order to be published and sent to app users, must be accurate in their use of spelling and grammar.

All information must be related to what you are advertising. For example, all ad creative fields submitted must represent the same advertiser and be related to the service or product being promoted.

3.2. Image Ads

Image ads allow an image to be included in the ad and are available in a single size. Ads of this type are subject to the guidelines below.

All images used in advertising must meet certain quality standards. Images may not be blurred and their arrangement must meet the standards required by 3warnings.

Therefore, they are not allowed:

  • Images that appear sideways or upside down, or that do not take up all the space of the chosen image size;
  • Blurry, poor quality, unrecognizable or with illegible text.

Image ads support animated images in GIF format. In this case, no animated images with the following characteristics are allowed:

  • Strobe, flickering or with other distracting elements;
  • With illegible text, poor image quality or blurred, unclear or unrecognizable visual elements;
  • Animations lasting more than 30 seconds. Shorter animations can be repeated or played continuously, but must be stopped after 30 seconds.

4. Prohibited Practices

4.1 Inappropriate advertisements for minors

No content that is not suitable for minors is allowed in any ad format, such as

  • The promotion of sex-related entertainment;
  • The sale of items designed to enhance sexual activity;
  • Ads relating to extramarital affairs;
  • Ads that include suggestive content, from a sexual perspective, with lewd language and/or relating to positions that may have a sexual connotation.
  • Intimate plastic surgery services.

4.2. Alcohol

Although minors are not allowed to use our app, we cannot guarantee that all our users are of legal age. Therefore, we do not accept ads related to alcohol or alcoholic beverages or similar.

4.3. Health care and/or medication

Advertisements related to health care and/or medicines are not allowed.

4.4. Political content

Advertising related to politics, political organizations, events for the financing of political causes, political parties and, in general, that which refers to politics and/or their candidates, is prohibited.

4.5. Dismissive Ads

3warnings does not allow advertisements with content that incites hatred or promotes discrimination or disparagement of a person or group on the basis of race or ethnic origin, religion, disability, age, nationality, veteran status, sexual orientation, gender or other characteristic associated with systematic discrimination or marginalization, e.g., content that promotes groups that incite hatred or the sale of products used by these groups, or that incites the dehumanization of a group of people or an individual, or the portrayal of an individual as inferior or deserving of hatred.

Nor does it allow content that harasses or intimidates a person or group of people. For example, pointing out someone as being abused or harassed

No advertising is allowed with content that threatens or advocates self-harm or assault on others, advocates suicide, anorexia or other types of self-harm; content that threatens someone with physical harm or calls for an attack on another person; that encourages, glorifies or justifies violence against others; content created by terrorist groups or shows support for these organizations; and content that celebrates or incites terrorist acts (including content that seeks to recruit members)

Finally, advertising with content that seeks to exploit others through extortion or blackmail is not accepted either.

4.6. Indecent content

3warnings does not allow the publication of advertisements that contain violent, obscene or foul language, unpleasant images or images or explanations of physical injuries, as well as representations of body fluids or waste or images that may frighten or impress users, due to their characteristics.

4.7. Events

Advertising that takes advantage of any negative event for profit, such as natural disasters, conflicts, wars, deaths or any other tragic event, is not allowed.

4.8. Animal cruelty

No advertisements promoting cruelty or gratuitous violence against animals, as well as those that are based on issues of animal trafficking, endangered species or the sale of products derived from such species, are permitted.

4.9. Explicit sexual content

Text, image, audio, or video advertisements for sexually explicit acts with the intent to arouse, as well as content that promotes non-consensual, underage, or other illegal sexual acts, are not permitted, regardless of whether it is simulated or real, and content that could be construed as promoting a sexual act in exchange for compensation.

4.10. Child abuse

Content that promotes the sexual exploitation of minors.

4.11. Marriage services

Advertising promoting the conclusion of marriages is also not permitted.

4.12. Games

3warnings does not allow advertisements related to gambling, or gambling games in physical premises, or online gambling, or promotion of websites that include or link to content related to online gambling.

Animated advertisements that include a game or contest in which users must participate to win prizes or other rewards, advertisements that encourage users to win a game or contest, or to claim prizes by clicking on them are also not permitted.

4.13. Weapons

No advertising of:

  • Ads for products that are designed to explode and may cause damage to persons or property nearby.
  • Ads for instructions on how to assemble or acquire explosive items.
  • Advertisements for firearms or related products are not permitted.
  • Advertisements for functional devices that appear to discharge projectiles at high speed, whether in sport, self-defense or fighting, are not permitted.
  • Advertisements for any part or component, finished or unfinished, that is essential or enhances the functionality of a gun.
  • Advertisements for instructions on how to assemble or improve functional devices (or their parts and components) that appear to discharge projectiles at high speed.
  • Advertisements for knives designed or promoted as products that can be used to injure an opponent in the fields of sport, self-defence or fighting
  • Ads for any knife design that offers advantages in a confrontation.
  • Advertisements for any other product designed to injure an opponent in the fields of sport, self-defense or fighting.
  • Advertisements for instructions on how to assemble, improve or acquire any product included in this section.

4.14. Drugs and Tobacco

Advertisements for substances that alter psychological state for recreational purposes or advertisements for products or services that are marketed to facilitate recreational drug use, as well as those aimed at instructing on how to produce, buy or consume this type of drug, are also not permitted.

Also prohibited are advertisements for tobacco or tobacco-containing products, for tobacco components and for products or services that facilitate or promote their use.

4.15. Financial products

The following are not allowed to be advertised:

  • Financial products and services that are related to the management or investment of money and crypto-currency, including personal advice.
  • Personal loans; those made by a person, organization or entity to a consumer on an ad hoc basis without the purpose of financing the purchase of fixed assets or paying for education.
  • Mortgages, car loans, student loans and revolving lines of credit
  • Advertisements for binary options and similar financial products.
  • Complex speculative financial products.
  • Crypto-currencies.

4.16. Telephone numbers and e-mail addresses

3warnings does not allow the insertion of contact telephone numbers in the description text of the ads published on the platforms.

Neither does it allow the insertion of e-mail addresses in the text of the description of the ads.

4.17. Downloads

Those ads that, when clicked on, initiate a file download on the user’s device, instead of redirecting to the advertiser’s website, are strictly forbidden.

4.18. Tickets for acts or events

Ads that facilitate the sale of tickets for events are also not permitted.

4.19. Technical assistance

Ads that provide information or facilitate third-party consumer support for online services and consumer technology products are not permitted. Ads such as technical support for troubleshooting or related to security, virus removal, internet connection, online accounts or software installation.

4.20. No identification of companies

Ads or landing pages that do not mention the product, service or entity they are promoting, such as those ads that do not include a product or company name or a visible URL, are not supported; Animated ads that do not clearly display identifying information, such as a product or company name, logo, or viewable URL in the final static image (after the animation is complete); ads or landing pages for companies with an unclear business model; and application ads that do not display the application name at any time during the ad interaction.

4.21. Fraud

Ads that induce fraud or promote fraudulent behaviour, such as

  • Ads that help users to deceive others, such as by creating false documents such as passports or diplomas, help in passing drug tests, job writing or impersonation services for exams, sale of forged user activity in the form of invalid clicks, reviews or membership in social media;
  • Advertisements for products or services that allow the user to gain unauthorised access to systems, devices or properties (hacking, theft of cable services, radar jamming, changing traffic signals, recording of calls or telephone tapping…).

4.22 Government agencies

Advertisements proposing to charge for goods or services offered by a public or official body free of charge or for a lower price, such as passport or driving licence application services; health card applications; official registration documents, such as birth certificates, marriage certificates or company deeds; test results; and tax calculations, are not permitted.

You can add a free element with another product or service you offer. For example, a TV provider may offer public content along with paid content or a travel agency may promote a visa application with a vacation package. However, the free product or service cannot be promoted as the main offer.

4.23. Counterfeits

3warnings does not accept advertising which promotes the sale of counterfeit products, that is to say, those which contain a distinctive sign which is the same as that of another company or which are very difficult to differentiate, imitating the characteristics of the brand of the original product in order to pass it off as the authentic one.

4.24. Bonding services

Advertising of bonding services, such as commercial bonding agents, bounty hunters, sureties, bond financing services, immigration bonding services and/or detention bonding services is not permitted.

4.25. Advertisements in countries or regions at risk

Geographically targeted advertising campaigns to countries or regions that may be considered at risk are not allowed, for the following reasons

  • They do not have adequate systems for preventing money laundering and/or financing of terrorism;
  • They are subject to sanctions, embargoes or similar measures approved by the European Union, the United Nations or other international organizations
  • They present significant levels of corruption or other criminal activities;
  • Have a significant offshore financial sector;
  • Facilitate the financing or support of terrorist activities;
  • Have the status of tax havens. All of the above without prejudice to being able to limit or have the freedom not to provide our services to any country that is henceforth declared to be at risk for political or economic reasons, for reasons of preventing money laundering or the financing of terrorism and/or any situation that puts our clients or users at risk.

It is the responsibility of the User-advertisers to inform themselves about the local legislation or regulations of the country to which they wish to direct their advertisements, as not all are governed by common regulations.

6. Other policies

The content of this policy is complemented by the other legal texts that make up the project and, above all, by the provisions of the Code of Conduct.
